May 16, 2023

Marshall Swadron spoke today at the Ontario Bar Association Trusts and Estates section program on Orders for Direction.

The program was chaired by Miller Thomson LLP lawyer Sheila Morris and addressed orders for direction in estate and guardiansdhip disputes. Orders for direction are court orders made early in an estate or guardianship dispute to define the issues in a case, govern how it will proceed and address interim matters.

Marshall participated in a panel together with Natalia Angelini of Hull & Hull LLP and Matthew Urback of Shibley Righton LLP on orders for direction in guardianship and power of attorney disputes under the Substitute Decisions Act, 1992 . The panel prepared an enhanced version of the Toronto Estates List model orders in guardianship matters focussing on interim preservation of assets, the production of records and capacity assessments.

The program qualified for 1.5 substantive hours of credit for continuing professional development.
