  • Swadron Associates advocates for clients who face restrictions on their liberty and treatment against their will. We also represent clients before the ORB. Our ease with the subject matter crosses over to the many types of applications heard by the CCB where we expand our representation to families and other affected parties.

  • Our firm’s approach to estate disputes is to be responsive to the needs of our clients in seeking early and fair resolutions through negotiation and mediation while litigating when necessary.

  • Our firm’s focus in our elder law practice is the enhancement of personal autonomy and the participation of individuals in their own decision making.

  • We serve as neutral mediators of disputes in all areas. Marshall Swadron brings 35 years of legal experience to this work while Jen Danch combines law and her prior social work career to help families navigate difficult waters. We are happy to host in-person two-party mediation sessions at our new offices.

  • We accept selected cases involving negligence claims against professionals, including lawyers and accountants. This area of practice often overlaps with our estate litigation practice.

  • Governments and the actions of those charged with enforcing the law have a significant impact on our everyday lives. We seek redress for assault, malicious prosecution and human rights breaches.

  • We act in matters as diverse as Charter and human rights proceedings, professional discipline matters, appeals to the Health Services Appeal and Review Board, coroner's inquests, judicial review applications and witness protection matters.

  • Swadron Associates lawyers accept court appointments to appear in criminal courts on behalf of victims and witnesses so that they may give their evidence while preserving their dignity. Our work in this area includes:

    • Representation of complainants and witnesses seeking to prevent the disclosure of their counselling and other records (O’Connor and Mills applications)

    • Representation of victims in sexual assault cases responding to applications to introduce evidence of prior sexual conduct (s. 276 applications)

    • Civil sexual assault claims against perpetrators and institutions
